Article 1 - Purpose
These conditions govern the sales by the company Gi NoGi Land of remote sales of sports articles.
Article 2 - Prices
The prices of our products are indicated in euros, all taxes included (VAT and other applicable taxes on the day of the order), unless otherwise indicated and excluding processing and shipping costs.
In the case of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These duties and sums are not the responsibility of Gi NoGi Land. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities.
All orders, regardless of their origin, are payable in euros.
The company Gi NoGi Land reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the rate in force at the time of the validation of the order and subject to availability.
The products remain the property of Gi NoGi Land until full payment of the price.
Attention: as soon as you take physical possession of the ordered products, the risk of loss or damage to the products is transferred to you.

The company Gi NoGi Land reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in case of supply problems, or in case of difficulty concerning the order received.
Article 4 - Validation of your order
Any order appearing on the website www.gi-nogi-land.fr implies adherence to these General Conditions. Any confirmation of an order implies your full and complete adherence to these general conditions of sale, without exception or reservation.
All the data provided and the recorded confirmation will be worth proof of the transaction.
You declare that you are fully aware of it.
The confirmation of the order will be worth signature and acceptance of the operations carried out.
A summary of the information of your order and of these General Conditions will be communicated to you in PDF format via the e-mail address of confirmation of your order.
Article 5 - Payment
The fact of validating your order implies for you the obligation to pay the indicated price.
Payment for your purchases is made using the secure Paypal system or in cash if you have chosen personal delivery.
The debit of the card is only made at the time of the shipment of the order. In case of split deliveries, only the shipped products are debited. If at the time of your order you choose the delivery method “hand delivery” you will have the possibility to pay your order in cash if you wish.
Article 6 - Withdrawal
In accordance with the provisions of Article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay a penalty.
Returns must be made in their original condition and complete (packaging, accessories, instructions), not worn other than to test, nor washed. In this context, your responsibility is engaged. Any damage suffered by the product on this occasion may be of such a nature as to defeat the right of withdrawal.
Return shipping costs are at your expense, however, we can help you organize this to make it as inexpensive as possible.
In case of exercise of the right of withdrawal, the company Gi NoGi Land will proceed to the reimbursement of the sums paid excluding shipping or return costs, within 14 days following the notification of your request and via the same means of payment as used at the time of the order.
EXCEPTIONS TO THE RIGHT OF WITHDRAWAL
In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:
The provision of services fully executed before the end of the withdrawal period and whose execution has begun after prior express agreement of the consumer and express renunciation of his right of withdrawal.

We do not accept exchanges. If you meet all the conditions, your order will be refunded and you will have to reorder later.

Article 7 - Availability
Our products are offered as long as they are visible on the site www.gi-nogi-land.fr and within the limits of available stocks. For non-stocked products, our offers are valid subject to availability from our suppliers. In case of unavailability of a product after placing your order, we will inform you by email. Your order will be automatically canceled and no bank debit will be made.
In addition, the website www.gi-nogi-land.fr is not intended to sell its products in large quantities. Therefore, the company Gi NoGi Land reserves the right to refuse orders for identical items.
Article 8 - Delivery
The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page.
In case of delay in shipment, an email will be sent to you to inform you of a possible consequence on the delivery time that was indicated to you.
In accordance with legal provisions, in case of delay in delivery, you have the possibility to cancel the order under the conditions and terms defined in article L 138-2 of the Consumer Code. If in the meantime you receive the product we will proceed to its reimbursement and to the shipping costs under the conditions of article L 138-3 of the Consumer Code.
In case of deliveries by a carrier, the company Gi NoGi Land cannot be held responsible for a delay in delivery due exclusively to an unavailability of the customer after several proposals for appointments. The different carriers used for the shipment of your packages are: Mondial Relay, Chronopost and Colis Privé.
Shipping costs are calculated according to the weight of your package.
From 70€ of purchase, shipping costs are free at Mondial Relay relay points for France, Belgium, Luxembourg and Spain.
From 70€ of purchase, other carriers benefit from a reduction of -33% to -50% for normal shipments or -25% for express shipments depending on the weight for Colis Privé, UPS, Chronopost and Mondial Relay home delivery.
Unless unforeseen circumstances beyond our control, any order placed before 2 p.m. will be sent the same day (excluding weekends).

Article 9 - Warranty
All our products benefit from the legal warranty of conformity and the warranty against hidden defects, provided for by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned, exchanged, or refunded.
All claims, requests for exchange or refund must be made by email within 14 days of delivery.
Defective products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions…). The shipping costs will be reimbursed to you on the basis of the invoiced rate and the return costs will be reimbursed to you upon presentation of the receipts.
The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

The products offered comply with the French legislation in force. The responsibility of the company Gi NoGi Land cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with the local authorities the possibilities of importing or using the products or services you intend to order.
Furthermore, the company Gi NoGi Land cannot be held responsible for damages resulting from misuse of the purchased product.
Finally, the responsibility of the company Gi NoGi Land cannot be engaged for all the inconveniences or damages inherent to the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.
Article 11 - Applicable law in case of disputes
The language of this contract is French. These terms of sale are subject to French law. In case of dispute, the French courts will be the only competent ones.

No one is authorized to reproduce, exploit, redistribute, or use in any way whatsoever, even partially, elements of the site whether they are software, visual or sound.
